PRIVACY POLICY

This Privacy Policy describes the information collected through
the Software that Magnolia River provides to Licensees and their end users,
including our online platforms and mobile applications, and how that
information is used and shared.
1. General. Magnolia River
collects Licensee information in an effort to improve
Licensee's online experience, and to communicate with Licensee about Magnolia
River's products and services. We do
not sell or rent Licensee’s personal information to third parties. However, Magnolia River may share Licensee’s
information with third parties that provide services on Magnolia River's behalf
or with whom Magnolia River has partnered to offer a particular product or
service.
2.
Use and
Acceptance. This
Privacy Policy applies to all users of the Software, including all Licensees
who have entered into a license agreement with Magnolia River for use of the
Software, employees of Licensee, and other end users. By accessing or using the Software, you
agree on behalf of the Licensee that you have read and understand this Privacy
Policy.
3.
Modifications
to this Privacy Policy.
This Privacy Policy is
incorporated into and made a part of each agreement governing access to and use
of the Software, including our license agreements and the EULA. Magnolia River reserves the right to modify
this Privacy Policy at any time, in our sole discretion. All changes will be effective immediately
upon posting to the Software. If any
modifications are material, Magnolia River will provide a prominent notice of
those changes on the Software or otherwise communicate those changes to
you. Continued use of the Software
following any modification to this Privacy Policy will constitute acceptance of
and agreement to be bound by those modifications. If you do not accept or agree to the
modifications, your sole and exclusive remedy is to stop using the Software.
4.
Information
Security. Magnolia River has taken physical, technical, and
administrative precautions to help protect against unauthorized access,
alteration, disclosure, and untimely destruction of information under our
control, including Secure Sockets Layer (SSL) technology and firewalls. The storage and communication of information
can never be completely secure, so we cannot and do not guarantee that email
messages, other communications, or information provided to us will be completely
secure. For this reason, we discourage,
for instance, the transmission by email of any information deemed sensitive.
5. Third-Party Websites and Software. The Software may contain links to, or be linked to, websites not maintained or controlled by Magnolia River. Such links are provided as a courtesy and for convenience only. We are not responsible for the privacy policies or security practices of any third parties or any third-party websites. We are not responsible for information collected by, or from, third-party websites. This Privacy Policy does not apply to any third-party websites or to any personal or other information that you may provide to third parties. You should read the privacy policy for each website that you visit.
6. Data
Collected. Magnolia River may collect information that
you voluntarily submit to Magnolia River, including but not limited to:
a.
Identifying information such as the Licensee's email address;
b.
Security information such as the Licensee’s username,
password, and acceptance of policies, licenses and warranties;
c.
Contact information such as the Licensee’s company name, and
phone number;
d.
Queries to Magnolia River for customer service and technical support;
e.
Site behavior such as pages visited, downloads, or searches requested;
f.
Browser information such as browser version, IP address, and
the presence of various plug-ins and tools; and
g.
Licensee’s GPS location and GPS location in background as a
requirement for GPS breadcrumb collection.
7.
Third-Party Service Providers. Magnolia River employs third-party service providers to perform various
functions on our behalf. Third-party
services may include, but are not limited to, developing, hosting
and maintaining our websites and databases.
We do not authorize any of these service providers to make any other use
of your information or to contact you outside the context of these services.
8.
Security Breaches.
In the event of a security breach of our systems, Magnolia River agree
to notify you, via your supplied email address, as to the severity of the
breach as soon as reasonably practical after the breach is identified. If you
become aware of any breach of Software security or this Privacy Policy, please
notify us at SoftwareSupport@magnolia-river.com immediately.
9. Data Destruction. At the
end of the Licensee’s subscription, Magnolia River agrees to destroy all
Licensee-specific data. You have the
option for an additional fee of requesting that Magnolia River freeze your
account and all the data therein for an agreed-upon period. At the end of that freeze period, you may for
an additional fee extend the freeze period.
If you choose not to extend the freeze, then all data will be destroyed
in accordance with Magnolia River's data retention policy.
10. Data Logging.
Magnolia River employs standard software logging capabilities for
troubleshooting and auditing activities.
You may formally request access to log data for their own internal auditing
activities.
11. Disclosure and Transfer of Personal Data. Magnolia River may disclose your data and
information to respond to subpoenas, court orders, and other legal processes,
as well as to establish or exercise our legal rights or defend against legal
claims. We may share your data and
information in order to investigate, prevent, or take
action against illegal activities, suspected fraud, potential threats,
violations of our Terms of Use, or as otherwise required by law.
